“In recent weeks, Zoom has become the virtual classroom for millions of schoolchildren and workspace for many businesses and government agencies. “In the wake of the global COVID-19 pandemic, demand for Zoom’s services exploded because hundreds of millions of people - all under stay-at-home orders - resort to videoconferencing to connect with others for work and social functions,” states the Zoom class action lawsuit. It recently went public, reporting a market capitalization exceeding $30 billion, according to the plaintiff. According to the complaint, Zoom uses a cloud platform that allows users to host video and audio conferences and webinars and allows users to collaborate remotely. Zoom is a company that offers remote conferencing services. Further, users have allegedly been subject to unwanted participants in a practice called “Zoombombing.”

TikTok, which has denied all allegations, said it settled for the payout to prevent the case from going to trial.Johnston says that, with the recent, unprecedented boost in the use of the service, Zoom has failed to appropriately protect its users from the disclosure of their data to third parties.

The suit also claims that TikTok mined users’ information from draft videos that were never posted. Illinois is the only state that allows people to sue companies for violating biometric privacy laws. The plaintiffs allege that TikTok violated the act, which prohibits companies’ using facial recognition to identify users or add them to a database of “faceprints” without explicit permission, according to the Cardozo School of Law’s journal, the Cardozo Law Review. “By utilizing this private and biometric information,” the suit continues, “TikTok maintains a competitive advantage over other social media apps and profits from its use of improperly obtained data, all while failing to comply with the minimum requirements for handling users’ biometric data established by” the state’s Biometric Information Privacy Act, which guarantees people the right to take action against companies that collect biometric data without consent.
